Omaric Elettronica Terms and Conditions of Sale
1. Scope
These Terms and Conditions of Sale govern the purchase of products sold by Omaric Elettronica through its e-commerce site, including educational kits, electronic components, manuals, accessories, and any digital services connected to the ELab brand.
By placing an order on the site, the customer confirms that they have read, understood, and accepted these terms. "Customer" means both a private consumer and anyone purchasing on behalf of a school, institution, business, association, or other organization.
2. ELab products
ELab products are educational kits designed for educational, hands-on, and training activities in electronics, coding, and STEM disciplines.
Omaric Elettronica reserves the right to update, improve, or replace components, packaging, manuals, or accessories included in the kits, provided such changes do not substantially alter the educational function of the purchased product. Any significant changes affecting an order already placed will be communicated to the customer, who may then confirm or cancel the purchase.
3. Orders
Submitting an order through the site constitutes an offer to purchase from the customer. After the order is submitted, the customer will receive a confirmation message summarizing the products purchased, shipping details, and the main information about the purchase.
Omaric Elettronica may refuse or cancel an order in the event of product unavailability, evident pricing or description errors, payment issues, incomplete data, or suspected misuse of the site.
4. Prices and payments
Product prices are shown on the site at the time of purchase. Unless stated otherwise, prices are in euros and include VAT where applicable.
Shipping costs, if any, are shown at checkout before the order is confirmed.
Payment must be made using the methods available on the site. Omaric Elettronica does not accept cash or checks for online orders, unless expressly stated otherwise.
In the event of an evident pricing error, Omaric Elettronica will inform the customer and may offer to confirm the order at the correct price or cancel it with a refund of any amount already paid.
5. Invoicing
The customer is responsible for the accuracy of the information entered when placing an order, including tax details, tax code, VAT number, recipient code, or certified email (PEC).
For schools, public bodies, or entities requiring specific administrative procedures, any special conditions must be agreed upon before the order is processed.
6. Shipping and delivery
Shipments are handled from Strambino, in the Ivrea area, through the Paccofacile service and the carriers available based on the destination, weight, volume, and characteristics of the order.
Delivery times shown at checkout are estimates and may vary depending on the carrier and destination. These times do not necessarily include the order preparation period.
Omaric Elettronica cannot be held responsible for delays caused by the carrier, force majeure events, strikes, weather conditions, customs checks, or other circumstances beyond its direct control.

7. Checking products on delivery
The customer is asked to check the package upon delivery and confirm that the packaging shows no obvious damage.
If a product is damaged, defective, incomplete, or different from what was ordered, the customer must contact Omaric Elettronica support as soon as possible, including a description of the issue and, if helpful, photos of the package and product.
8. Returns and right of withdrawal
Consumer customers have the rights provided under applicable law regarding online purchases. Within the European Union, a consumer is generally entitled to withdraw from an online purchase within 14 days without giving a reason; Omaric Elettronica may apply a more favorable commercial window, such as the 30-day return period indicated in its own policy.
For physical ELab products, a return may be requested within 30 days of receipt, following the process described in the Omaric Elettronica Return and Refund Policy.
The product must be returned intact, complete with all components, manuals, accessories, and original packaging. Returns cannot be accepted for products that are damaged, incomplete, tampered with, permanently assembled, or no longer resellable due to reasons attributable to the customer.
The following are excluded from returns, unless otherwise required by law:
- custom or made-to-order products;
- electronic components that have been soldered, cut, altered, or tampered with;
- digital licenses, software, online content, or platform access already activated;
- products purchased on sale, clearance, or through special promotions where expressly indicated.
9. Refunds
After receiving and inspecting the returned product, Omaric Elettronica will let the customer know the outcome of the request.
If approved, the refund will be issued through the same payment method used for the purchase, unless otherwise agreed. Any additional costs related to premium shipping services, insurance, or special options may not be refundable, except where required by law.
10. Legal warranty
Products sold to consumers are covered by the legal warranty of conformity provided under applicable law. Within the European Union, goods must conform to the contract, match their description, be fit for their intended purpose, and be of satisfactory quality; otherwise, the consumer may be entitled to repair, replacement, a price reduction, or a refund as provided by law.
The warranty does not cover damage resulting from misuse, incorrect assembly, tampering, modification of components, failure to follow the instructions, non-compliant electrical connections, ordinary wear, or use of the product for purposes other than its intended educational use.
For professional customers, schools, institutions, or businesses, the warranties provided under applicable law and any specific agreed conditions apply.
11. Software, the ELab platform, and digital content
Some ELab products may include or provide access to software, digital platforms, AI assistants, simulators, digital manuals, educational content, or online services.
Access to these tools is granted for educational and training purposes, according to the terms indicated on the site, in the product documentation, or in any specific platform terms.
The customer may not copy, resell, distribute, modify, decompile, bypass protection systems, reverse engineer, or use ELab software for unauthorized purposes.
Software features may be updated, improved, suspended, or changed over time for technical, educational, security, or maintenance reasons.
12. Intellectual property
The ELab brand, manuals, educational content, images, texts, diagrams, digital materials, the software platform, and every other original element connected to the products are owned by Omaric Elettronica or their respective rights holders.
Purchasing a product does not transfer any intellectual property rights to the customer, aside from the right to use the product and materials provided for their intended educational purpose.
Any third-party trademarks appearing in the kits, components, or documentation remain the property of their respective owners.
13. Proper use of the products
ELab kits are intended for low-voltage educational, demonstrative, and hands-on activities, according to the instructions provided.
The customer agrees to use the products in accordance with the law, the safety instructions, the technical documentation, and their intended use.
In a school setting, activities must be carried out under the supervision of teachers, educators, or other responsible adults.
14. Limitation of liability
Omaric Elettronica is not liable for damage resulting from improper use of the products, incorrect connections, unauthorized modifications, failure to follow the instructions, use with unsuitable power sources, or use of the kits in contexts other than their intended educational purpose.
Technical and educational support provided by Omaric Elettronica is intended to assist and guide, but does not guarantee the resolution of every issue, nor does it replace the customer's responsibility for using the products correctly.
This does not exclude any limitation of liability not permitted by law, including consumers' non-waivable rights.
15. Export and international use
The customer agrees not to use, resell, export, or transfer the products in violation of applicable laws, regulations, international sanctions, or restrictions.
Omaric Elettronica may refuse or suspend orders destined for countries, individuals, or areas subject to operational, customs, or regulatory restrictions.
16. Events beyond Omaric Elettronica's control
Omaric Elettronica will not be liable for delays or failure to fulfill its obligations resulting from events beyond its control, including natural disasters, wars, pandemics, strikes, logistics disruptions, carrier issues, actions by authorities, material shortages, or other force majeure causes.
In the event of a significant delay, the customer will be notified and may request cancellation of the order for products not yet received, with a refund of any amounts already paid.
17. Protection of personal data
The customer's personal data will be processed in accordance with applicable data protection law and as described in the site's Privacy Policy.
Data may be shared with parties needed to manage the order, such as payment providers, carriers, logistics services, e-commerce tools, and administrative entities, solely for purposes related to the sale, shipping, invoicing, and support.
18. Governing law and jurisdiction
These Terms and Conditions are governed by Italian law.
Consumers retain any non-waivable rights provided under the law of their country of residence or domicile, where applicable. Any disputes will be referred to the competent court under applicable law.
For professional customers, businesses, institutions, or parties not qualifying as consumers, the competent court will be the one indicated in the specific sales conditions or, failing that, the one provided under Italian law.
